1. Acceptance of Terms

By accessing or using Pureclaim's services, website, or any applications made available by Pureclaim (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Services.

We may modify these Terms at any time. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.

2. Account Registration

To access certain features of the Services, you may be required to register for an account. You agree to provide accurate, current, and complete information and to update this information to maintain its accuracy. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

We reserve the right to suspend or terminate your account if any information provided during registration or thereafter proves to be inaccurate, false, or misleading.

3. Subscription and Payments

Unless otherwise specified:

  • All payments are non-refundable
  • Subscriptions automatically renew unless canceled before the renewal date
  • You can cancel your subscription at any time from your account settings

We may change our fees and payment terms at our discretion. If we do so, we will provide notice and the changes will apply to future billing cycles.

4. Intellectual Property Rights

The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio) are owned by Pureclaim, its licensors, or other providers and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Services for your internal business purposes. You may not:

  • Reproduce, distribute, modify, or create derivative works of the Services
  • Use any data mining, robots, or similar data gathering methods
  • Remove any copyright, trademark, or other proprietary notices
  • Use the Services for any commercial purpose not expressly permitted by Pureclaim

5. User Content

You retain all rights to any content you submit, post, or display on or through the Services ("User Content"). By providing User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute such content in connection with providing the Services.

You represent and warrant that:

  • You own or have the necessary rights to use and authorize us to use your User Content
  • Your User Content does not violate the rights of any third party
  • Your User Content complies with these Terms and applicable law

6. Prohibited Conduct

You agree not to:

  • Use the Services in any way that violates any applicable law or regulation
  • Impersonate any person or entity or misrepresent your affiliation
  • Engage in any conduct that restricts or inhibits anyone's use of the Services
  • Attempt to gain unauthorized access to the Services or related systems
  • Use the Services to transmit any malware or viruses
  • Use the Services to send unsolicited communications
  • Interfere with the proper working of the Services

7. Disclaimers and Limitations of Liability

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND. PURECLAIM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT WILL PURECLAIM BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO PURECLAIM FOR THE SERVICES DURING THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

8. Indemnification

You agree to indemnify, defend, and hold harmless Pureclaim and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

9. Termination

We may terminate or suspend your account and access to the Services, with or without notice, for any reason, including if you violate these Terms. Upon termination, your right to use the Services will immediately cease.

All provisions of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of California, without regard to its conflict of law principles. Any dispute arising from or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in San Francisco County, California.
